Terms and conditions
These terms and conditions set out the basis for assignments, advice, inspections, training and other ATEX services provided by Exquintia.

DNR and ATEX-specific terms
The assignment is subject to DNR 2025, or DNR 2011 if expressly agreed, supplemented by the ATEX-specific terms of Exquintia.
In case of conflict, the following order of precedence applies: the signed order confirmation, the ATEX-specific appendix, the technical scope, and then the general terms.
Local statutory obligations of the client as employer, operator, manufacturer, importer or user remain fully applicable.

Client responsibility
The client remains responsible for safe operations.
The employer or operator remains responsible for risk assessment, explosion protection documentation, a safe workplace, implementation of measures, maintenance, instruction, supervision and management of change.
Exquintia can advise, prioritise and verify, but the client must implement, release and secure measures.
Supplied information
Supplied information determines the scope and reliability of the advice.
If SDSs, P&IDs, layouts, ventilation data, process data or maintenance information are missing or incorrect, the advice cannot extend beyond the available information.
The client remains responsible for timely, complete and accurate information about installations, processes, substances, equipment and operations.
Scope boundaries
Scope boundaries are strict. An assessment of one installation, zone or document does not mean that the entire company is ATEX-compliant.
Reports are prepared for the agreed context and may not be used for other installations, locations or conditions without review.
Conclusions are based on available information, the recorded reference date and the situation assessed during the assignment.
No certification
No certification is provided unless expressly agreed in writing.
An ATEX advice, inspection report or EPD update is not CE certification, not a Notified Body certificate and not a product conformity declaration.
Standards version and reference date
The applicable standards version and reference date are recorded per assignment.
Examples include IEC 60079-14:2024, IEC 60079-17:2023, IEC 60079-10-1, IEC 60079-10-2, NPR 7910-1/2 or ISO 80079-36/37, depending on the assignment.
Changes and residual risk
Changes may invalidate advice.
A change in process, substance property, raw material, ventilation, cleaning, installation, operating duration, ambient temperature, maintenance or operating mode may affect zoning and measures.
Residual risk remains. Explosion safety is risk reduction and control, not an absolute guarantee that an explosion is impossible.
Inspections
Inspection is sample-based or scope-bound unless otherwise agreed.
For existing installations, it must be clear whether the inspection is visual, close or detailed, and which part of the installation was assessed.
European and international assignments
Unless explicitly agreed otherwise, Dutch law applies.
The assignment will be performed as an expert advisory service within the agreed scope.
The client remains responsible for compliance with applicable national implementation of ATEX workplace legislation, occupational safety law, environmental law and operational safety obligations in the country where the installation is located.
Assignment execution
Exquintia performs work based on the agreed scope, supplied information and professional expertise.
These terms are intended for assignments, advice, inspections, training and other Exquintia services and should be read together with the applicable DNR terms and ATEX-specific terms.
Reports and use
Reports are prepared for the agreed context and may not be used for other installations, locations or conditions without review.
Conclusions are based on available information and the situation assessed during the assignment.
Liability and payment
Liability is limited in accordance with the applicable DNR terms, the order confirmation and any further written agreement, to the extent permitted by law.
Invoices, payment terms and suspension rights are recorded in the offer or order confirmation.
